These Terms govern your use of the Wing Eye app ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, please don't use the App.
Wing Eye is a bird species recognition game: you're shown a photo of a bird and asked to identify it from two options. It's supported by advertising and does not require an account to play.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial entertainment. You may not:
A photograph of a bird is a modern, separately-copyrighted work belonging to whoever took it — unlike the species itself, the photo isn't free simply because the bird is common or widespread. Every photo shown in the App is checked, image by image, directly against its iNaturalist license metadata before being included, and only photos under a clearly free license (such as CC0, CC BY, or CC BY-SA) are used. Where a license requires attribution, the observer's or photographer's credit is shown in the App under "More about this bird" alongside the photo.
Descriptive text shown in the App's "More about this bird" panel is sourced live from Wikipedia and is licensed under Creative Commons Attribution-ShareAlike (CC BY-SA) — a different license than the photos themselves. It's provided for informational context within the App and links back to the original Wikipedia article; it is not licensed to you for separate reuse outside the App.
Everything else — the App's design, code, game mechanics, branding, and the selection and curation of content — is owned by gallery-eye.app and protected by copyright and other applicable laws.
We make a genuine effort to ensure species, family, and license information is accurate, including automated verification against iNaturalist's license records. However, this content is ultimately sourced from third-party, community-contributed sources (iNaturalist, Wikipedia), which can themselves contain errors. We don't guarantee the accuracy or completeness of any content shown in the App.
The App is free to play and is supported by advertising served through Google AdMob and its partner network, under its own AdMob app registration separate from our other apps. Ads are subject to Google's own terms, and your interactions with ads are governed by our Privacy Policy and Google's policies, not by us directly.
The App includes an optional public Leaderboard and optional private, password-protected Friends Boards. If you choose to use either, your best streak and a display name you choose become visible to other players — publicly on the Leaderboard, or only to fellow members of a Friends Board you've joined. You agree not to use a display name that is offensive, impersonates another person, or infringes anyone's rights. We may remove or reset any Leaderboard or Friends Board entry, including yours, at our discretion — including for names we consider inappropriate, or scores that appear implausible or manipulated.
Friends Boards are self-service: anyone with a board's join code can join it, and a board's creator is responsible for choosing and safeguarding its admin password and for who they share the join code with. We are not responsible for who a board's creator or members choose to admit. Neither the Leaderboard nor Friends Boards use individual player accounts or authentication beyond a board's own password. We make reasonable efforts to keep both accurate but do not guarantee the integrity of any score shown, and are not liable for inaccurate, manipulated, or lost Leaderboard or Friends Board data.
Wing Eye's Leaderboard and Friends Boards are entirely separate from Gallery Eye's and Castle Eye's — a display name, score, or board on one app has no connection to, and does not carry over from, the others.
The App is intended for a general audience. If you are under the age of 13 (or the relevant minimum age in your country), you should only use the App with the involvement of a parent or guardian.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the App will be uninterrupted, error-free, or available at all times — it depends on third-party services (including Supabase, iNaturalist, and Wikipedia) that are outside our control.
To the maximum extent permitted by law, gallery-eye.app will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App.
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above. Continuing to use the App after changes take effect means you accept the revised Terms.
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it.
